Car & Truck Valuation – You must obtain and list an accurate market value for all of your vehicles when you file for bankruptcy. The following sites will provide a free market value analysis. Edmunds.com and Kelly Blue Book are preferred and more accurate for several reasons. First, Edmunds.com and Kelly Blue Book provide a “private party sale” valuation. For bankruptcy purposes, private party sale is the most accurate valuation method. According to Kendall Law, NADA does not provide a “private party sale” valuation option. Second, Edmunds.com and Kelly Blue Book both make an allowance for the condition of your vehicle. If your vehicle is in fair or poor condition, both Edmunds.com and Kelly Blue Book properly make a downward valuation adjustment to account for vehicle condition. NADA improperly assumes that all vehicles are in “clean” condition.

Case Information Databases – Weber Law Firm clients should use these sites to monitor the receipt of plan payments and view creditor addresses, claim amounts, and important dates, including dates set for creditor meetings and court hearings on confirmation or dismissal. I strongly encourage all clients to review the plan payment information on these sites before calling the Trustee’s staff to discuss payment issues. The information on this site is the same information viewed by the Trustee’s staff. You will save a lot of time if you determine whether your plan payment was received before calling the Trustee’s staff.

E-Pay – Each Trustee has an “e-pay” system.  It will allow you to immediately initiate a plan payment to the Trustee through a bank transfer of funds from your bank to the Trustee’s bank.  Payments made prior to 4:00 p.m. central time will be debited from your account the same day and will be posted the next business day to your bankruptcy case.  If you can’t afford to make your full plan payment at one time, you may make several smaller payments through the month. There is a $1.50 processing fee for each payment.

Credit Counseling Agencies. This is a list of the approved credit counseling agencies. Scroll down to the “Southern District of Texas” for a list of the agencies approved for Debtor’s that file in the Houston / Galveston metropolitan area.

Debtor Education Providers. This is a list of the approved debtor education providers. Scroll down to the “Southern District of Texas” for a list of the providers approved for Debtor’s that file in the Houston / Galveston metropolitan area.

Means Testing Information. This link contains the median income and IRS expense data used for means testing a debtor’s eligibility to file for bankruptcy under Chapter 7, and the amount that a debtor will be required to pay payment plan for persons that file under Chapter 13.

Prime Rate History Chart – This site will tell you the prime interest rate on any given date for the previous ten years. This is important in Chapter 13 bankruptcy cases, because in the Southern District of Texas, the interest rate paid on many secured claims are calculated at the prime rate plus two percent as of the date the bankruptcy case was filed.

Free Annual Credit Report  The federal Fair Credit Reporting Act requires each of the three nationwide consumer reporting companies (Equifax, Experian, and Trans Union) must provide consumers with a free copy of their credit report, on request, once every 12 months.  This website allows consumers to obtain their free yearly credit report.
